FMCSA denies ELD waiver requests for ten organizations

Successful Dealer’s sister publication CCJ reported Friday that the Federal Motor Carrier Safety Administration (FMCSA) has denied ten electronic logging device (ELD) exemption requests from various trade organizations and associations.

FMCSA officially denied the requests in June and July, but it is required to publicly announce the denials in the Federal Register.

Among the organization’s denied an ELD exemption was the Owner-Operator Independent Drivers Association (OOIDA), American Disposal Service, Association of Energy Service Companies and Agricultural Retailers Association.

In denying OOIDA’s request, FMCSA states the association’s request challenged the basis of the ELD rule itself rather than justifying an exemption and provided no consideration “of the significant difficulty that would be encountered in trying to identify and validate drivers who meet the proposed exemption criteria, especially during roadside inspections.”

Safety was cited as the reason for denying the requests of the other three groups mentioned above.
